1.2. You can contact us by email at tgmastery@gmail.com or by post at the address above.
1.3. These Terms of Service set out the rules for using the Store and for concluding distance sales contracts through it. Please read them before placing an order. They are available free of charge at any time on this page and can be saved or printed.
1.4. In these Terms:
- Customer means any person who places an order in the Store;
- Consumer means a natural person who buys for purposes not directly related to their business or profession;
- Entrepreneur with consumer rights means a natural person running a business who concludes a contract directly related to that business, where the contract is not of a professional nature for them (in particular as shown by their entry in the Polish CEIDG register); such persons benefit from the consumer provisions on the right of withdrawal and unfair terms, as provided by Polish law;
- Entrepreneur means any other Customer buying in connection with their business.
2. Use of the Store
2.1. To use the Store you need a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active email address.
2.2. We provide the following electronic services free of charge: browsing the Store, the order form, a customer account (optional), the contact form and the newsletter. You may stop using any of them at any time, and you can unsubscribe from the newsletter using the link in each email.
2.3. You must not provide unlawful content or use the Store in a way that disrupts its operation.
3. Orders and conclusion of the contract
3.1. Product information in the Store is an invitation to conclude a contract. You place an order by completing the checkout and confirming the obligation to pay.
3.2. After you place an order we send an automatic email confirming receipt. The sales contract is concluded when we send you an email accepting the order for processing.
3.3. Our products are made of natural wood and wood veneers. Natural differences in colour, grain and texture between products, and differences from photos caused by screen settings, are a normal feature of the material and are not a defect.
4. Prices and payment
4.1. Prices are shown in the currency selected in the Store. For deliveries within the European Union, prices include VAT. Delivery costs are shown at checkout before you place the order.
4.2. For deliveries outside the European Union, the Customer may have to pay import duties, taxes and customs fees charged by the destination country.
4.3. You can pay by the methods available at checkout, including payment cards and PayPal. The order is processed after payment is received.
5. Production and delivery
5.1. The estimated production and dispatch time is shown on the product page or at checkout. Delivery times and areas are described in our Shipping Policy.
5.2. We recommend checking the parcel on delivery and, if it is damaged, writing a damage report with the courier. This helps us handle a complaint quickly but does not affect your statutory rights.
6. Right of withdrawal
6.1. A Consumer or an Entrepreneur with consumer rights may withdraw from the contract within 14 days without giving any reason. The period starts on the day you (or a person you indicated, other than the carrier) receive the goods.
6.2. To withdraw, send us a clear statement, for example by email to tgmastery@gmail.com. Sending the statement before the period expires is enough.
6.3. Return the goods to the address given in our Refund Policy no later than 14 days after sending the statement. You bear the direct cost of returning the goods.
6.4. We will refund all payments received, including the cost of delivery (up to the cheapest standard delivery we offer), within 14 days of receiving your statement, using the same payment method unless you agree otherwise. We may withhold the refund until we receive the goods back or proof that they have been sent.
6.5. You are liable for any reduction in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
6.6. The right of withdrawal does not apply to goods made to the Customer's specification or clearly personalised, such as custom-sized orders.
6.7. Our Refund Policy may grant additional, more favourable return options. It never limits the rights described above.
7. Complaints and liability for non-conformity
7.1. We are liable to Consumers and Entrepreneurs with consumer rights for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within 2 years, in accordance with the Polish Consumer Rights Act. You may request repair or replacement, and in cases provided by law a price reduction or withdrawal from the contract.
7.2. Please send complaints to tgmastery@gmail.com with your order number, a description of the problem and, if possible, photos. We will reply within 14 days.
7.3. Towards Entrepreneurs, liability under the statutory warranty for defects (rękojmia) is limited to 1 year from delivery, to the extent permitted by law.
7.4. Complaints about the electronic services may be sent to the same email address and will be answered within 14 days.
8. Personal data
8.1. The controller of personal data is the Seller. Details of how we process personal data are set out in our Privacy Policy.
9. Out-of-court dispute resolution
9.1. A Consumer may use out-of-court complaint and redress procedures, for example by contacting a district or municipal consumer ombudsman (rzecznik konsumentów), applying to a permanent consumer arbitration court at the Voivodeship Inspectorate of Trade Inspection, or asking for mediation. Information about these procedures is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK).
9.2. Using these procedures is voluntary and does not affect the right to go to court.
10. Governing law and jurisdiction
10.1. These Terms and contracts concluded through the Store are governed by Polish law.
10.2. If you are a Consumer living in another country, this choice of law does not deprive you of the protection given by the mandatory provisions of the law of your country of residence.
10.3. Disputes with Consumers are resolved by the courts competent under generally applicable law. Disputes with Entrepreneurs are resolved by the court competent for the Seller's registered office.
11. Changes to the Terms
11.1. We may change these Terms for important reasons, such as changes in the law, in payment or delivery methods, or in the functioning of the Store. We will publish the new version on this page.
11.2. Orders placed before a change are governed by the Terms in force when the order was placed.
12. Final provisions
12.1. Nothing in these Terms limits the rights of Consumers or Entrepreneurs with consumer rights under mandatory provisions of law. If any provision is less favourable than the law, the law applies.
12.2. If you have any questions about these Terms, contact us at tgmastery@gmail.com.
